UnderCover Party - Terms of Service

1. Acceptance of Terms

By downloading, installing, or using UnderCover Party (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms supplement the Arouay Studio General Terms of Service and the UnderCover Party Privacy Policy. Where these App-specific Terms conflict with the general Terms, these Terms control.

2. Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority in your country, you must have your parent or legal guardian's permission to use the App.

For users in the European Economic Area, the minimum age may be higher under local law.

We may, at our discretion, terminate accounts that we reasonably believe belong to underage users.

3. Anonymous Account

UnderCover Party signs you in automatically using an anonymous identifier — no email, phone number, or social account is required. The identifier is tied to your device's secure storage.

You are responsible for activity that occurs under your anonymous account on a given device. If you lose access to the device, you may lose access to the account; this is an accepted limitation of anonymous identity and is described in the Privacy Policy.

4. User-Generated Content

The App allows you to submit text, including but not limited to nicknames, chat messages, in-game text inputs (such as clues), and seat names for co-located players. We refer to this collectively as "User-Generated Content" or "UGC".

4.1 Your Content, Your Responsibility

You are solely responsible for your UGC. You represent that:

You have the right to submit it
It does not violate these Terms or any applicable law
It does not infringe anyone's intellectual property, privacy, or other rights

4.2 License to Us

You retain ownership of your UGC. By submitting UGC, you grant Arouay Studio a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, transmit, display, modify, and moderate that UGC for the purpose of operating, improving, and promoting the App.

4.3 Visibility

UGC submitted in a public room is visible to all participants in that room, including strangers. UGC submitted in a private room is visible only to participants of that room. Treat any UGC you submit as public — once shared, you cannot guarantee that other participants will not screenshot, copy, or redistribute it.

5. Community Rules

When using the App, you must NOT:

Harass or threaten others — including bullying, intimidation, sexual harassment, doxxing, or stalking
Post hateful content — slurs, insults, or attacks based on race, ethnicity, nationality, religion, gender identity, sexual orientation, disability, or other protected characteristics
Share personal information — your own or anyone else's, including real names, addresses, phone numbers, financial information, or login credentials
Solicit personal information — asking other players for their real-world identity, contact details, photos, or any other personal data
Engage with minors inappropriately — any sexual content involving minors is strictly prohibited and will be reported to the National Center for Missing & Exploited Children (NCMEC) and local law enforcement
Spam or impersonate — flooding chat, advertising, phishing, or pretending to be another user, public figure, or company representative
Post illegal content — including but not limited to content that infringes copyrights, depicts real-world violence, or facilitates criminal activity
Evade enforcement — creating a new account to bypass a suspension, ban, or other restriction we have placed on you
Disrupt the service — including exploiting bugs, using automation/bots, reverse-engineering, or attempting to gain unauthorized access

6. Moderation & Enforcement

We reserve the right, but are not obligated, to:

Review, screen, or filter UGC at any time, with or without notice
Remove or edit UGC that violates these Terms
Suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to other users
Cooperate with law enforcement when legally compelled to do so

Other players in a room may kick or report users whose behavior violates these Terms. Repeated reports against a user may result in temporary or permanent suspension at our discretion.

We do not pre-moderate every message. The absence of moderation at a given moment does not mean we endorse or take responsibility for any UGC.

7. Intellectual Property

All software, artwork, music, theme word lists, role descriptions, and other content provided by Arouay Studio in the App are owned by us or our licensors and are protected by copyright and other intellectual property laws.

You receive a limited, non-transferable, non-exclusive, revocable license to use the App for personal, non-commercial purposes only. You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written permission.

8. Third-Party Services

The App may integrate third-party services (such as AdMob for advertising, where applicable). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices of third parties.

9. Termination

You may stop using the App at any time by uninstalling it.

We may suspend or terminate your access to the App, in whole or in part, at any time, with or without notice, for any reason, including but not limited to violations of these Terms.

Upon termination:

Your right to use the App ceases immediately
We may delete your anonymous account and associated data, subject to the data retention rules described in the Privacy Policy
Provisions of these Terms that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability, governing law) will continue in effect

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

We do not warrant that:

The App will meet your requirements
The App will be available, secure, or free from defects at all times
Any UGC posted by other users will be accurate, lawful, or non-offensive

You use the App at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AROUAY STUDIO AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY EUROS (€50), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify and hold Arouay Studio, its affiliates, and its officers, employees, and agents harmless from any claim, demand, loss, or damage (including reasonable attorneys' fees) arising out of or relating to:

Your UGC
Your use of the App
Your violation of these Terms
Your violation of the rights of any third party

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the developer's country of residence, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the App will be resolved in the courts having jurisdiction in the developer's place of residence, unless mandatory consumer-protection rules in your country of residence give you the right to bring proceedings in your local courts.

These Terms are drafted in English. If a translated version is provided for convenience, the English version controls in case of any discrepancy, except where local consumer-protection law requires otherwise.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will:

Post the updated Terms on this page
Update the "Last Updated" date at the top
For significant changes, present the updated Terms within the App and require you to accept them before continuing to use the App

Your continued use of the App after the updated Terms take effect constitutes acceptance of the changes.

16. Game-Specific Rules

UnderCover Party is a social-deduction party game played in real-time rooms with other players. The following rules supplement the general Community Rules in Section 5.

16.1 Public Rooms

Public rooms are open to anyone using the App. By creating or joining a public room, you understand that:

Your nickname and any UGC you submit (chat messages, clues, votes, reactions) will be visible to strangers
You may encounter content from other users that you find offensive — use the in-room kick and report tools if needed
The host of a public room may remove (kick) any player at their discretion

If you are not comfortable with these conditions, use private rooms (invite-only by code) or party rooms (co-located play with people you know).

16.2 Nicknames

Your nickname is visible to every player in every room you join, and is listed in the public-room browser. Nicknames must comply with the Community Rules in Section 5. We may rename or remove nicknames that violate these rules without notice.

16.3 In-Game Text (Chat & Clues)

The App allows you to submit free-text messages in two contexts:

Chat messages — broadcast to everyone in the room
Clues — short text submitted on your turn, broadcast to the room as part of gameplay

Both are subject to the Community Rules in Section 5. We may rate-limit, redact, or block messages that we detect as harmful, spammy, or in violation of these Terms.

16.4 Co-located Seat Names (Party Mode)

In Party Mode, the host adds named seats for co-located players sharing a device. By adding a seat name, the host represents that they have the consent of the person being named. Seat names are subject to the same rules as nicknames.

16.5 Reporting

Every public room exposes a report action on each participant. Reports are reviewed by us and may result in warnings, temporary suspensions, or permanent bans depending on severity. Submitting deliberately false reports is itself a violation of these Terms.

16.6 No Empty-Room Camping

You may not host or keep public rooms open without intending to start a game. Holding empty public rooms to inflate visibility, farm engagement, or waste other players' time is a violation of these Terms and may result in restrictions on your ability to host public rooms.

16.7 No Cheating

You may not use any third-party tool, modified client, network manipulation, or coordinated cross-room communication to gain an unfair advantage over other players. Examples include but are not limited to: revealing role information out-of-band, automating gameplay, or using multiple accounts to influence votes.

16.8 Game Content

The role descriptions, theme word lists, and game balance rules are part of the App and are protected as set out in Section 7. You may not reproduce or redistribute the role catalog or theme word lists outside the context of normal gameplay.

17. Reconnect and Forfeit

If you intentionally leave a room (using the explicit Leave button), the game treats you as having forfeited and your seat is released immediately. If your connection drops unexpectedly (network loss, app backgrounded, device powered off), the App holds your seat for a short grace period — currently 30 seconds — before forfeiting.

This is a gameplay rule, not a guarantee: actual reconnect behavior depends on network conditions and is not warranted under Section 10.

18. Purchases and Virtual Items

UnderCover Party is free to play and offers optional in-app purchases. This Section supplements the general Terms above.

18.1 In-App Purchases

The App offers optional purchases, which may include premium theme (word) packs, pack bundles, an ad-free upgrade, and consumable credits for optional in-game features. All purchases are processed by the Apple App Store or Google Play under their respective terms. We do not process or store your payment details (see the Privacy Policy, Section 17).

18.2 Licence, Not Ownership

A purchase grants you a personal, non-exclusive, non-transferable, revocable licence to use the purchased content or feature within the App, tied to your anonymous account. You do not acquire ownership of the underlying content, and you may not resell, sublicense, or transfer it. The role catalog and theme word lists remain protected as set out in Section 7.

18.3 Consumable Credits

Consumable credits (for example, credits used for optional in-game assistance) are consumed as you use them, have no monetary value, cannot be exchanged for cash, and are non-transferable. They are non-refundable except where required by law or by the store's policy. Unused credits may be lost if your account is deleted.

18.4 Refunds

Refunds are handled by the App Store / Google Play under their policies. We do not process refunds directly; please direct refund requests to the relevant platform.

18.5 Prices, Availability, and Changes

Prices, product availability, and the contents of the shop may change over time, and individual items may be modified or discontinued. Where you have already purchased a perpetual entitlement (such as a theme pack or the ad-free upgrade), we will not revoke it because of a later price or catalog change, except where necessary for legal, security, or technical reasons.

18.6 Restoring Purchases

You can restore previously purchased non-consumable entitlements using the "Restore purchases" action in the settings. Restored entitlements are re-synced to your anonymous account, including after reinstalling the App or signing in on a new device.
